Even though employers have seen significant wins in wage and hour class action litigation in the last few years, plaintiffs’ counsel continues to file these actions and to develop new theories. Winston and Strawn partners Joan Fife and Emilie Woodhead discussed the latest wage and hour issues employers face and strategies for addressing them. Areas addressed include:
- An update of significant cases
- Trends in certification of class and collective actions, and the role statistical evidence plays
- Whether arbitration agreements can be used to avoid class actions
- An update for what's happening in California, including claims for PAGA penalties, seating cases, and cases to watch in the next year
