Jonathan Brightbill Speaks at ABA Section of Environment, Energy, and Resources’ 30th Fall Conference

On September 22, Winston & Strawn Partner and Environmental Litigation and Enforcement Practice Chair Jonathan Brightbill will speak on a panel at the ABA Section of Environment, Energy, and Resources’ 30th Fall Conference.
Jonathan’s panel, titled “A Fifty-Year Journey into the Unknown: A Historical Review of the Clean Water Act’s Beginnings to Guide Future Policy,” will cover the historical context critical for insightful deliberation of today’s controversial Clean Water Act disputes.
Panelists will engage in a collegial debate regarding how the act’s history could, or should, be interpreted to support different outcomes on timely issues relevant to water-law practice, such as the definition of waters of the United States, the regulation of combined sewer overflows, and jurisdiction over groundwater. The panel also will discuss how recent Supreme Court decisions on agency deference could impact future review of Clean Water Act regulations, including the definition of Waters of the United States.
