Winston Attorneys Danielle Williams and DaWanna McCray were featured in the October 9 ALM “Skilled in the Art” column detailing the first patent trial of the Judge Alan Albright era.
Mike noted the measures that Judge Albright has taken on courtroom safety and said, “I think the court has bent over backward to make sure the jury feels safe.”
In addition, Danielle and DaWanna were mentioned for their WacoWatch posts that have provided an overview of each day’s proceedings.
In discussing the ongoing case, where MV3 is asserting a single patent on a mobile set top box, it alleges that Roku’s products infringe by performing casting and mirroring functions that allow content from a mobile device to be shown on another display. Roku isn’t challenging validity, instead focusing on individual claim elements and arguing that its products don’t meet at least eight of them.
However, according to Mike, MV3 is “not really living in the claims as much.” Instead MV3 has argued that the patent describes mirroring and casting and that the Roku products provide those benefits. “As patent lawyers we think, ‘Well, that’s not so relevant to an infringement analysis,’” he said. “But I think it’s easier for a jury to understand, and again will remain to be seen if that’s effective or not.”
