Winston Lawyers Weigh in on Prospect of NAFTA Deal in 2018

Latin America Practice Litigation Associate Michael Fernández is quoted in a February 14 Latinvex article titled “NAFTA Deal This Year?” The article includes perspectives from industry executives and others close to the NAFTA negotiations on the likelihood that the United States, Mexico, and Canada will meet the March 31 deadline for a new agreement.
Michael comments on NAFTA’s Chapter 11 investor-state dispute settlement (ISDS) mechanism, which he says “Trump administration officials have publicly criticized...as an invasion of sovereignty and as a measure that incentivizes companies to outsource to Mexico.” As such, an ISDS provision could be excluded from a NAFTA revamp, he says.
