Winston Secures Rare Bail Pending Appeal for Incarcerated Client

In a remarkable victory, Winston & Strawn Partner Harvey Kurzweil and Law Clerk Jeenie Kahng secured bail pending appeal for an African-American veteran serving a 6-year sentence for an alleged drug sale.
“The team obtained a stunning and almost unheard of win in the Appellate Division. Pending appeal, our client will be released 4 years into a 6-year sentence for selling a $20 rock,” said Harvey Kurzweil.
Winston’s client suffers from chronic lung and heart disease and is pre-diabetic. As a result, he is at serious risk of death if he contracts COVID-19 while incarcerated. Thankfully, he was released on his own recognizance following a successful application for bail pending appeal that the Winston team argued before a justice of the Appellate Division. The client is extremely grateful to the Winston/Legal Aid team for securing his release and providing him with an opportunity to safeguard his health. Winston is representing the client on his appeal and his request for executive clemency.
