In this podcast, we discuss how Judge Albright recently revised the Order Governing Procedures (OGP) in his court, making changes in three primary areas. The procedures on which Judge Albright focused his OGP changes included: drawing a line between pre-Markman and post-Markman issues in Rule 16 Case Management Conferences; adding default discovery limits for venue and jurisdictional discovery; and modifying his Markman procedures by reducing the number of presumed claim terms and changing briefing from simultaneous to staged briefing. We also discuss the unresolved claim construction issues that arose in Judge Albright’s recent MV3 v. Roku trial.
