Consolidated Wage and Hour Class Action Cases in Northern California
Winston successfully resolved a consolidated legal saga on behalf of a provider of safety services for refineries, which began when we took over two wage and hour class actions from two law firms that had been handling both cases for more than a year. After they failed to defeat motions for leave to amend and file first amended and second amended complaints, we defeated a motion for leave to file a third amended complaint. Subsequently, and as a result of complicated procedural wrangling, we had eight class actions pending before one judge, and successfully worked with several refineries (indemnified by our client) to convince them to follow our lead despite the differences in their cases. Ultimately, we had eight lawsuits consisting of class, collective, and/or representative actions all pending in the N.D. Cal., asserting overlapping wage and hour claims pursuant to the Fair Labor Standards Act and the state laws of California, Illinois, Minnesota, and Washington. Following a private mediation, all plaintiffs and our client reached a very favorable global settlement, resolving all claims, cases, classes, and parties.
