Secured High-Profile Fifth Circuit Dismissal for Avanci of Closely Watched Technology-Antitrust Case

In February 2022, we secured an important appellate win for Avanci, the joint licensing agent for standard essential patents (SEPs) for the 2G, 3G, and 4G wireless standards. The Fifth Circuit turned back an antitrust challenge from Continental Automotive Systems finding that SEP holders can engage in platform licensing without  running afoul of U.S. antitrust law. Am Law bestowed Litigator of the Week recognition on us for this high-profile victory.

Continental sought rehearing twice and the Fifth Circuit Panel reaffirmed its ruling against Continental both times.
