Winston Resolves Class Action Involving Automotive Navigation Software Advertising Claims

Winston defended Mazda Motor of America Inc. in a putative nationwide class action alleging violations of California’s UCL and CLRA, breach of express warranty, and violation of the Magnuson-Moss Warranty Act. Plaintiff alleged that Mazda falsely advertised a navigation software that purported to offer “real-time” or live traffic alerts as an add-on tech package to its 2016 model-year cars. We successfully settled the case on a single-plaintiff basis prior to class certification after our motion practice made class certification untenable.
