Technology assisted review (“TAR”) and predictive coding are the most talked-about topics in eDiscovery, as companies grapple with ways to contain discovery costs and to minimize their litigation exposure. Practical advice on TAR and predictive coding, without the marketing hype, is imperative, as companies need to determine what strategies, if any, they should pursue. In addition, the October 31, 2012 Duke Conference on Technology Assisted Review and the November 1, 2012 Federal Rules Advisory Committee meeting on potential amendments to the Federal Rules implicating preservation will help shape the eDiscovery landscape.
John Rosenthal, chair of the firm's eDiscovery and information management practice group led this practical, interactive presentation that provided insight on the latest federal rule changes and developments concerning technology-assisted review.
The webinar explored hot button issues such as:
- Possible changes to Federal Rules 16, 26 and 37 designed to address the burdens associated with the preservation of ESI; and
- The lack of a uniform standard imposed by federal courts in weighing sanctions motions for failure to preserve ESI.
