Associate Gino Cheng presented “Update on Recent U.S. Federal Circuit Briefing: How To Structure Licenses to Avoid Patent Exhaustion” at a Licensing Executives Society Chinese Taipei (LESCT) event on October 22, 2015.
The presentation summarized the positions advanced by the appellant, appellee, and U.S. Government as an amicus in the briefing and October 2, 2015, oral hearing before the Federal Circuit en banc in the pending Lexmark v. Impression Products appeal on the issues of international patent exhaustion and using post-sale restrictions (conditional sales) to thwart domestic exhaustion.
