Golinveaux Discusses DMCA Safe Harbor

Intellectual property partner Jennifer Golinveaux, based in Winston & Strawn's San Francisco office, spoke to the Business Law Section of the State Bar of California on July 12, 2011. During the presentation, "State of the Law on THE DMCA Safe Harbor," Ms. Golinveaux discussed the Digital Millennium Copyright Act ("DMCA") and the current state of the law on the safe harbor from claims of copyright infringement. She also addressed:
- the status of the appeals in UMG v. Veoh in the Ninth Circuit and Viacom v. YouTube in the Second Circuit and key issues raised by those appeals;
- other noteworthy recent decisions concerning applicability of DMCA safe harbor;
- recent decisions concerning DMCA Section 512(f), which provides remedies for misuse of the DMCA's notice and take down provisions; and
- the newly announced ISP "Copyright Alert System."
Ms. Golinveaux concentrates her practice on complex copyright, trademark, and Internet litigation and counseling.
