J.C. Masullo Speaks at ACI’s Summit on Medical Device Patents

Patent Litigation Attorney J.C. Masullo spoke at ACI’s 7th Advanced Summit on Medical Device Patents on March 1. This year’s conference addressed the impacts of the new administration on patent reform and medical device inventions, Halo and the new willfulness standard, and the offensive and defensive use of the inter partes review process. Winston & Strawn also served as a sponsor of the conference.
Mr. Masullo spoke on the “Dodging the § 101 Rabbit Hole: Patentability of Medical Devices and Related Software Post Alice” panel, which addressed the following topics:
- Digging into recent case law impacting patentability of these technologies
- Stepping out of the abstract idea and natural phenomena classifications
- Satisfying the PTO’s “significantly more” standard
- Securing the broadest scope of protection
- Factoring in freedom to operate analyses
Mr. Masullo focuses his practice on patent litigation involving complex electrical and computer technologies in Federal District Courts as well as in Section 337 proceedings before the U.S. International Trade Commission (ITC).
