Speaking Engagement
October 19, 2023
Winston partner Jason Lewis recently spoke at the 99th International Energy Credit Association (IECA) Conference on October 19, 2023 in Las Vegas, NV. Each year the IECA brings together credit risk, legal, and contract administration professionals to network, share knowledge, and to discuss the latest energy industry trends. This year’s conference, titled “Don’t roll the dice on risk!” focused on potential risks in the current energy market—including political, market, credit, and regulatory risk—and the need to think clearly about them.
Jason’s presentation, titled “PPA 101,” provided a crash course for industry professionals on the basic elements of power purchase agreements (PPA), including common nomenclature and typical transaction structures (including the “virtual” power purchase agreement (vPPA)), as well as a deeper dive into the provisions that buyers and sellers frequently negotiate.
Key takeaways
- “PPA” is a broad umbrella encompassing a range of commercial arrangements, including with respect to conventional and renewable generation, and including the physical and financial sale of products.
- Due to the significant variations between individual PPAs, standardizing the applicable documentation will be difficult.
- As a result, it is as important as ever to pay close attention to the language of each PPA.
