Jonathan Brightbill Discusses FERC’s Climate Policy in Hart Energy

Winston & Strawn Partner Jonathan D. Brightbill sat down with Hart Energy to discuss The Federal Energy Regulatory Commission’s (FERC) recent climate policy statement regarding natural gas infrastructure projects, which would require permits for such projects to involve projections of emissions from construction, operation, and users of transported gas.
The policy has been widely debated within the industry and is likely to be tested in the courts.
“I think there are very serious and legitimate questions raised about FERC’s legal authority to do all of the things that are articulated in the policy statement,” Jonathan said. “I think that there are likely to be very credible legal challenges about FERC’s jurisdiction and authority to either directly require or implicitly request, obviously under duress, certain of the measures and information requests that are set forward here.”
