On June 6, Winston & Strawn International Arbitration Partner Matthew Bate spoke on a panel titled “Creating Effective Memorials and Witness Statements in International Arbitration” at Practising Law Institute’s International Arbitration 2022 conference in New York.
If your company or client has a dispute arising from a contract with a foreign party, international arbitration represents the best method of resolving that dispute in a neutral forum and enforcing any subsequent award. Matthew Bate and other panelists discussed critical issues and provided information needed to successfully navigate the international arbitration process such as:
- How to interview witnesses effectively
- Selecting the right witnesses for your case
- Preparing reliable witness statements and memorials
- Discussing what goes into the memorial versus the witness statement
- Exploring whether you can eliminate witness statements
Speakers shared their insights and experience on drafting pleadings and memorials, conducting document disclosure, preparing witness statements, conducting effective cross-examinations, and presenting expert evidence, all in a “round table” style format.
As the round tables revealed, international arbitration is a hybrid between common law and civil law procedures, and advocates should be live to the significant differences with U.S. court litigation.
