Nimalka Wickramasekera Named Among the Top IP Lawyers of 2024 by the Daily Journal

The Daily Journal named Winston & Strawn partner Nimalka Wickramasekera to its 2024 list of California’s Top Intellectual Property Lawyers. Honorees were chosen due to their exceptional work on recent, significant cases that impacted intellectual property law.
In a Q&A with the publication, Nimalka discussed her stand-out matters from the past year: “The two cases I would highlight are NuVasive, Inc. v. Alphatec Spine, Inc. (Case No. 37-2017-00038583-CU-BC-CTL, California Superior Court, San Diego County) and NuVasive, Inc. v. Patrick Miles & Alphatec Holdings, Inc. (C.A. No. 2017-0720-SG, Delaware Chancery Court).
“I spearheaded trials in each of these cases, which were conducted a month apart and spanned different regions of the country, for a longstanding patent client. The cases were at the heart of a multifaceted, multijurisdictional, protracted dispute between head-to-head competitors in the spinal medical device industry. Central to both trials were allegations of breach of fiduciary duty and unfair competition. The main witnesses in these trials included the CEO and the general counsel, both of whom were on the stand for multiple days. Following a rigorous trial period of over six weeks, the jury delivered a verdict that overwhelmingly vindicated our client, dismissing claims totaling over US$30M in damages along with punitive damages. The exhaustive efforts of myself and my team resulted in a near-complete victory in a years-long bet-the-company dispute against our client.”
