Steve Stodghill Provides Perspective on Pursuing Legal Claims in Court During the COVID-19 Pandemic

Steve Stodghill, Winston & Strawn Dallas litigation partner, recently wrote an article for the Dallas Business Journal addressing common questions related to pursuing legal claims while courts are shut down during the coronavirus pandemic.
Although most courthouses are currently closed, Steve explains that a large amount of legal work, including deposing a witness under oath or conducting pretrial hearings, is being handled electronically or by a video or telephone conference call. However, Steve believes that some important trial procedures, such as jury selection and deliberation, cannot be replicated using remote technology.
Steve suggests that we may see similar trends as we saw during the 2008 recession, another turbulent time in history. “We saw more parties willing to settle. They either didn’t have the money to continue or wanted some sort of outcome now, so that they could move on. But then, coming out of the recession, we also saw a wave of new cases.”
