Teams Led by Chuck Klein and Michael Elkin Recognized in The American Lawyer’s Litigator of the Week Column

Two Winston & Strawn teams were highlighted for their notable wins in The American Lawyer’s Litigator of the Week column on January 7, 2022.
The first, led by partner Chuck Klein, secured a win for the firm’s generic drug client, Hikma Pharmaceuticals. Delaware U.S. District Judge Richard Andrews dismissed a patent challenge brought by Amarin tied to its sole branded product, Vascepa. The label for Hikma’s generic product “carved out” the cardiovascular indication and Andrews found Hikma’s marketing and public statements had not induced infringement of Amarin’s patents. The team also included partner Eimeric Reig-Plessis, associates Claire Fundakowski and Alison King, and paralegal Alissa Hodgson.
The other team, led by Vice Chairman Michael Elkin, represented the owners of Wolfgang’s Vault, a website where users pay to access concert recordings from the 1950s through the 1990s. In a decision from the Ninth Circuit, Winston got two separate classes of musicians decertified in a case alleging that the site violates copyright and anti-bootlegging laws. The team also included partners Jeff Wilkerson.
