Winston’s Dallas Office Managing Partner Tom Melsheimer was recognized for successfully defending prominent bariatric surgeon William Daniel Nicholson, who was indicted in a kickback scheme involving $40 million in alleged bribes. The case involved a two-year investigation and included 21 medical professionals and executives from Forest Park Medical Center in Dallas. Of the nine defendants who went to trial, Nicholson was the only one acquitted, with Melsheimer using a novel application of health care fraud laws. “The challenge was to highlight the distinctions in Dr. Nicholson’s conduct without blaming any co-defendants. If you have a trial where everyone is blaming others, that’s a prescription to get everyone convicted.”
