What to Know About the New Illinois Employee Sick Leave Act

On August 19, 2016, Illinois Governor Bruce Rauner signed House Bill 6162, creating the Employee Sick Leave Act, which will take effect January 1, 2017. The act provides Illinois employees with more flexibility in their use of sick leave benefits. In particular, although the act does not require employers to provide employees with sick leave benefits, it requires employers who do provide sick leave benefits to allow employees to use those benefits to care for ill or injured family members. However, an employer may cap the use of sick leave benefits to be used for family member care at six months’ worth of accrued sick time.
