Winston & Strawn intellectual property partner Michael Elkin, based in the firm's New York office, spoke at the 23rd Annual Corporate Counsel Conference on June 7, 2011 in New York.
Mr. Elkin led the presentation titled "Copyright Law and the Internet's Evolution Continues to Break New Ground – Three Cases and a New Law that Shook the World." This luncheon panel discussion focused on how the rights and obligations of artists and content distributors have clashed in the wake of precedent-setting court decisions and reform legislation intended to create a more level playing field and what it all means for every GC whose industry feeds off the "new media." Topics included:
- The Supreme Court's Grokster decision, the concept of "Willful Blindness" and the pending MP3tunes.com case in the Southern District of New York
- How the DMCA's "safe harbor" provisions triggered rough seas as well as smooth sailing
- Viacom v. YouTube and UMG v. Veoh Network help define the practical as well as legal implications for ISPs and copyright owners
