Winston Team Recognized in Litigator of the Week Column

A Winston & Strawn team was highlighted for their notable win in The American Lawyer’s Litigator of the Week column on March 11, 2022.

The attorneys scored a major appellate reversal for Cox Communications. In October 2021, Cox Communications, Inc. retained Winston & Strawn to represent it in an appeal to the Delaware Supreme Court following a post-trial adverse judgment against Cox by the Delaware Court of Chancery in an action Cox filed against T-Mobile relating to Cox’s plan to launch a mobile services platform in partnership with Verizon. 

On March 3, 2022, the Delaware Supreme Court issued a decision in favor of Cox Communications, Inc., reversing the Delaware Court of Chancery’s decision in Cox v. T-Mobile, vacating the injunction against Cox, and remanding the case to the Court of Chancery for it to determine whether Cox and T-Mobile have discharged their obligations to negotiate in good faith as required by Section 9(e) of the Settlement Agreement.
