Winston Team Recognized in The Am Law Litigation Daily’s Litigator of the Week Column

A Winston & Strawn team led by Jeffrey Kessler, David Greenspan, and Diana Leiden was recognized in the Litigator of the Week column by the Am Law Litigation Daily on March 21, 2025.

The shout-out stems from the team’s representation of the Major League Baseball’s players union in litigation against sports gambling platform DraftKings Inc. The players brought claims related to the use of their names, images, and likenesses in promoting so-called “prop bets” based on the performances of individual players. U.S. District Judge Karen Marston in Philadelphia this week allowed the players’ right-of-publicity claims to move forward.

“At this early stage, these allegations are sufficient to plausibly allege that each player—even purportedly ‘lesser known’ players like former-Phillies (now-Baltimore Orioles) relief pitcher, Gregory Soto—has a valuable interest in his NIL,” Marston wrote. David argued the motion to dismiss for the player’s union.

The team also included Benjamin Gordon, Robert Pannullo, and Isabella Caito.
