Key Matters
- Won a motion to dismiss on all counts of a multistate and multiclaim consumer class action complaint alleging breach of warranty, fraud, unjust enrichment, and consumer fraud claims.
- First-chaired an asylum evidentiary hearing for a pro bono client, preparing the client for hearing, conducting a direct exam, and delivering a closing argument, resulting in a grant of asylum for the client.
- Defending an automobile manufacturer and distributor in several putative class action lawsuits alleging breach of warranty, fraud, unjust enrichment, and unfair and deceptive trade practices in connection with the manufacturing, design, advertising, marketing, and/or sale of the vehicles.
- Prepared a case for trial, handling all aspects of litigation that included evaluating claims and legal issues, preparing for witness examinations and opening statement at trial, and drafting and arguing pre-trial motions. Ultimately secured a favorable outcome for the client on the eve of trial.
- Second-chaired an arbitration resulting in a favorable verdict for a vehicle financing company.
- Prepared appellate briefs on various contractual and patent-related issues before the U.S. Court of Appeals for the Federal Circuit.
- Successfully obtained a preliminary injunction in federal court, challenging a state regulation with widespread commercial consequences based on First Amendment free speech grounds.
- Advised clients on potential legal risks related to a number of internal and external business practices, contracts, and policies.
- Prepared and argued motion to strike class allegations in a breach of fiduciary duty class action lawsuit.
- Prepared a motion for preliminary injunction and third-chaired an oral argument in federal court, challenging state regulation based on dormant commerce clause grounds.
- Prepared and won a motion for summary judgment under the Freedom of Information Act, challenging the federal government’s withholding of certain documents.
