Winston & Strawn partner Sara Susnjar was quoted in a recent Lexology article discussing the complaint filed by privacy group Noyb claiming social networking app BeReal violated users’ consent through misuse of cookie banners. Noyb has asked CNIL, the French regulatory body that ensures data privacy laws are applied to the collection, storage, and use of personal data, to fine BeReal and order its compliance following five alleged breaches of the GDPR over the consent banners used by the company since July 2024.

On December 10, our New York office hosted a Financial Crimes Compliance Group panel discussion on “Enforcement and Supervision Trends: What DFS-Licensed Institutions Need to Know.” Our panelists, led by former New York Department of Financial Services (NYDFS) insiders, including Richard Weber, prior General Counsel, gathered for an engaging discussion. They provided insight on NYDFS enforcement and supervisory priorities, along with recent licensing-requirement updates. The panelists discussed best practices for responding to DFS actions, negotiating penalties, and multi-agency dynamics.

A class action is a procedural device that allows one or more persons, usually plaintiffs (though federal and state procedural rules also authorize defendant classes) to file suit on behalf of a group of similarly situated persons. Federal law defines a class action as “any civil action filed under Rule 23 of the Federal Rules of Civil Procedure or similar State statute or rule of judicial procedure authorizing an action to be brought by 1 or more representative persons as a class action.” 28 U.S.C. § 1332(d)(1)(B), (d)(8).

Loot boxes are randomized collections or boxes of virtual items, often made available for purchase with money. A player who purchases a loot box in a game does not know its contents until he or she opens the box, causing advocacy groups and government actors to liken loot boxes to games of chance, and to call for their regulation under gambling laws.
