Sandra Edwards and Jared Kessler Discuss Consumer Greenwashing Lawsuits with Bloomberg Law
Winston & Strawn partners Sandra Edwards and Jared Kessler were quoted in a recent Bloomberg Law article discussing the surge in consumer greenwashing lawsuits involving microplastics and how scientific research and news reports often lead to class actions. In the first half of 2024, at least eight prospective class action lawsuits have been filed alleging that branding like “all-natural” is misleading if a product may contain microscopic plastic pieces. The lawsuits follow a study from the New England Journal of Medicine that found microplastics lead to a higher risk of heart attacks and strokes, and a University of California San Francisco review of 2,000 scientific studies found that ingesting microplastics could increase risk of cancer.

Greenwashing is the act of making false, misleading, or exaggerated claims about an entity’s environmental or sustainability record or practices, including the environmental impact of operations, products, or services. Greenwashing reflects a gap between the symbolic and substantive action taken by a company or product in order to gain an environmentally friendly image. For example, greenwashing occurs when a company spends time and money advertising goods or services as environmentally friendly, closer to nature, or otherwise “green,” when the impact on the environment is not materially distinct from other comparable goods or services.

ESG, or environmental, social, and governance (ESG), Investing refers to the making of investment decisions by environmental and/or socially conscious investors based on a set of standards or requirements for a company’s behavior. Environmental criteria consider how a company protects the environment, including corporate policies addressing climate change. Social criteria examine how a company values and supports relationships with employees, suppliers, customers, and its local communities. Governance deals with, among other things, a company’s leadership, executive compensation, and shareholder rights.
