The United States International Trade Commission (ITC) is an increasingly popular venue for patent infringement litigation. More and more companies are seeking to halt importations of infringing products into the United States by turning to the ITC for expedited relief. Section 337 investigations conducted by the ITC provide complainants with a “fast track” to remedy IP matters that typically go to trial within 10 months. Since many Section 337 cases go to trial, selecting an ITC litigation team with a command of the technology, patent law, and specialized procedural practice is extremely important. We have handled more than 100 cases before the ITC.

FERC’s New Transmission Rule: From “Band-Aids” to Open Heart Surgery or Something in Between?
The United States transmission system is getting ready to run a marathon during a heart attack. Vast projected increases in demand on the system due to electrification, explosive growth in data centers, and other drivers (the marathon), coupled with ineffective transmission development leading to congestion exacerbated by the proliferation of renewable generation resources located far from load centers (the heart attack) has created growing concern that the grid will not be able to deliver electricity where needed at reasonable prices.

Generic drugs are typically small, chemically synthesized molecules—that is, they have relatively low molecular weights, frequently less than 1000 daltons and usually between 300 and 700 daltons. Biosimilars, on the other hand, are typically substantially larger in molecular weight than small molecule drugs. For example, a monoclonal antibody—a typical biosimilar drug—generally has a molecular weight in excess of 150,000 daltons. In contrast, aspirin—a typical small molecule drug—has a molecular weight of 180 daltons.
