Recently, the U.S. antitrust authorities released a new antitrust guidance warning that, in a departure from past practice, the Department of Justice intends to pursue criminal cases against companies and individuals that enter into certain types of no-poach and wage-fixing agreements. This new guidance – along with recent litigation and enforcement activity – heightens the potential exposure of executives, including human resource professionals, who are involved in hiring and compensation decisions. The litigation has targeted a wide range of companies and conduct that constrains wages, salaries, benefits, terms of employment, and even job opportunities.
