Key Matters
- Certain Underwriters at Lloyds of London v. Abbott Laboratories. Successfully defended a recession claim and obtained an US$85M judgment on behalf of Abbott Laboratories under product recall insurance policy following a lengthy trial in the Circuit Court of Cook County.
- Morningstar, Inc. v. The Mills Corporation. Obtained a fraud judgment after a trial on behalf of Morningstar, Inc. in connection with a long-term commercial real estate lease.
- Motorola, Inc. v. Lemko Corp.; Huwai Technologies, Inc. Represented Motorola, Inc. in bringing action for theft of trade secrets.
- Roadmaster Corporation v. General Electric Company. Defended a US$100M breach of warranty claim arising under the UCC.
- United States v. General Electric Company. Successful defense of a criminal price-fixing action after six-week jury trial.
- In re Flat Glass Antitrust Litigation II. Defended a nationwide class action alleging that PPG Industries, Inc. (PPG) conspired to fix prices and energy surcharges for construction flat glass from 2002 to 2006.
- In re Automotive Refinishing Paint Antitrust Litigation. Represented PPG in a nationwide antitrust class action litigation alleging price fixing.
- Crichton v. Golden Rule Insurance Company. Successfully defended a large class action challenge to health insurance premiums under the Illinois Consumer Fraud and Deceptive Practices Act.
- JoAnn Howard and Associates P.C. v. Cassity, et al. Defended a major bank against a breach of fiduciary duty case arising from a large pyramid scheme.
- Fox v. Prime Group Realty Trust, et al. Defeated a preliminary injunction to prevent a merger and defended against breach of fiduciary duty claims.
- Credit Bureau Services Inc. v. Corelogic Inc. Successfully defended an alleged conspiracy to restrain trade in violation of the Sherman Act.
- In re America Continental Corporation/Lincoln Savings and Loan Securities Litigation. Four-month jury trial regarding class action securities fraud claims arising out of the failure of Charles Keating’s Lincoln Savings and Loan.
- United States v. National On Leong Chinese Merchants Society. Successfully defended a criminal RICO prosecution after five-month jury trial.
