Eric Shinabarger

An experienced privacy and data protection counselor, Eric focuses his practice on helping companies develop comprehensive privacy and security compliance programs, monitoring and analyzing developments in state, federal, and international privacy regulation, and assisting companies with preparation and response to potential data security incidents.
As a key partner in Winston’s Global Privacy & Data Security practice and Regulated Personal Information (RPI) team, Eric has deep experience advising clients on the creation of privacy and data security compliance programs as well as on the best strategies to improve on existing practices. Eric’s experience includes counseling clients on compliance with the Illinois Biometric Information Privacy Act (BIPA), the EU and UK General Data Protection Regulation (GDPR), the U.S. Health Insurance Portability and Accountability Act (HIPAA), state privacy laws such as the California Consumer Privacy Act (CCPA), the California Invasion of Privacy Act (CIPA), the Video Privacy Protection Act (VPPA), the Red Flags Rule, CAN-SPAM, the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), the Telephone Consumer Protection Act (TCPA), and both state and federal unfair, deceptive, and abusive acts and practices laws. Eric also devotes much of his practice to incident response and preparation, including preparing for breaches through developing incident response plans and leading executive tabletop exercises, and assisting clients with evaluating and responding to threatened or actual security incidents.
Eric also regularly advises on privacy and data security matters associated with mergers, acquisitions, investments, and other significant corporate transactions. This includes handling post-closing remediation issues that implicate privacy and security and advising portfolio companies on an ongoing basis. This also includes working with clients to negotiate large-scale commercial contracts that involve the transfer, use, and/or security of personal information.
Eric has also represented clients in responding to regulatory investigations brought by state and federal regulators including state attorneys general and the DOJ, FTC, CFTC, SEC, OCR, and PCAOB. He has worked on appeals in both federal and state courts, drafted and argued dispositive motions, and conducted internal investigations. Eric recently succeeded in overturning a pro bono client’s public housing eviction before an Illinois appellate court and in obtaining a grant of asylum for a pro bono client before an immigration court.
Eric is a member of the firm's Videogame, Gaming and Esports Group dedicated to providing comprehensive legal solutions to companies in these industries.

Eric is a member of the International Association of Privacy Professionals and is a Certified Information Privacy Professional (CIPP/US certificate). He also serves as a member of the Business Advisory Council for Taylor University.
Before joining Winston, Eric completed a fellowship with the Public Interest Law Initiative (PILI), where he worked with the National Immigration Justice Center, an organization that provides free legal services to impoverished immigrants and asylum seekers. At Chicago-Kent, Eric was the CALI Award Recipient for Legal Writing, Labor Law, and Labor and Employment Externship, and won first place overall and best brief in the 2014 McGee Civil Rights Moot Court Competition.

Education
Eric received his B.S. in Political Science/Systems from Taylor University in 2009, and his J.D., magna cum laude, from Chicago-Kent College of Law in 2015. While at Chicago-Kent, Eric served as the Executive Articles Editor of the Chicago-Kent Law Review, was elected to the Order of the Coif, and was an active member of the Chicago-Kent Moot Court Honor Society.
Before law school, Eric worked as a data analyst for McLean Bible Church, and was a legislative correspondent with the Office of Congressman Mark Souder.
