Winston & Strawn LLP represented Forge Nano (the Company), a global leader in precision nano-coating technology in a US$50+M funding led by key investments from Korea’s Hanwha Corporate Venture Capital with participation from OIC, Catalus Capital, Ascent Funds, and existing investors. This funding brings the Company’s total amount of capital raised to date to more than US$95M. The financing will allow Forge Nano to capitalize on its already growing commercial-scale nanotechnology opportunities for battery material as well as develop a battery production line to satisfy full-scale, premium battery contracts. Plans are underway to launch construction of the pilot battery production line in Q2 2023 that will support applications including aerospace, consumer electronics, defense, and more.

Winston Helps Secure Release of Binance Executive Imprisoned on Bogus Charges in Nigeria
A Winston team, led by New York partner Rich Weber, played an important role in convincing the Nigerian government to drop its baseless money laundering and tax evasion charges against Binance executive Tigran Gambaryan and release him from prison. Tigran was released on October 24, 2024, after eight months of imprisonment, and is back in the United States where he is receiving medical treatment for malaria and double pneumonia, which he contracted while in prison, as well as for complications from a herniated disk.

A federal contract is a binding contract or agreement with an authorized official of any agency or department of the U.S. Government for the purpose of purchasing goods, products or services of any kind, or purchasing, renting, or leasing property, for the direct use or benefit of the U.S. Government. Federal contracts are the procurement mechanism the U.S. Government uses to obtain such goods, products, services, and property across all sectors and industries. Federal contracts may be express or implied and may be of various different types, e.g., fixed-price, cost-reimbursement, time and materials, indefinite delivery/indefinite quantity (IDIQ).

A bid protest is a challenge to the government’s proposed contract award for the procurement of goods and services, or a challenge to the terms of a solicitation for such a contract. A bid protest at the federal level is typically heard at the Government Accountability Office (GAO) but can also be directed to the procuring federal agency, and in certain instances, to the Court of Federal Claims (COFC). Since there are strict timelines for filing a bid protest, it is imperative to consult with counsel. See 4 C.F.R. § 21.2; see also Bid Protests At GAO: A Descriptive Guide (Ninth Edition, 2009). A bid protest is further described at Federal Acquisition Regulation (FAR) 33.103; 33.104; and 33.105.
